Terms of Service

The short version

  • Pay for the plan you're on. Cancel anytime — it's a button, not a phone call.
  • Your data is yours. Export it whenever you want, including after you cancel.
  • Magie drafts; you approve. What you approve and send is your responsibility.
  • Use it for lawful business. Don't spam people. Don't store medical records — we're not HIPAA-certified.

1. The agreement

These terms are a contract between you and MagieCRM ("we," "us") covering your use of the MagieCRM service at magiecrm.com and app.magiecrm.com (the "Service"). By creating an account or using the Service, you agree to them. If you're signing up on behalf of a business, you're agreeing for that business, and "you" means the business.

You must be at least 18 and using the Service for business purposes.

2. What the Service is

MagieCRM is a CRM that gets built around your business: you describe how you work, Magie (our assistant) sets up trackers, fields, pipelines, forms, and automations, and you approve what it builds. It includes AI-assisted features — reading photos and emails into records, drafting changes and automations on request. We continuously improve the Service, which means features can change; we won't remove something you depend on without telling you.

3. Your account

Keep your login credentials to yourself and let us know at support@magiecrm.com if you think your account has been compromised. You're responsible for what happens under your account, including what your team members do with the seats you give them.

4. Plans, the $5, and billing

  • Plans. Current prices are on the pricing section — they're on the page on purpose. Plans differ by number of people and active records, not by features. Extra seats beyond your plan's included count are $15/person/month.
  • The $5 build fee. Trying MagieCRM costs $5, which pays for building your CRM with you. It's charged once, before any subscription, and it's credited to your first month if you subscribe. It is not refundable. Whether or not you subscribe, you keep your data export.
  • Billing. Subscriptions bill monthly in advance through Stripe. If a payment fails, we'll retry and let you know before anything is restricted.
  • Canceling. Cancel anytime from the Stripe billing portal, reachable from your billing settings. You keep access through the end of the period you've paid for. We don't do partial-month refunds, but we also don't do cancellation phone calls or retention specialists.
  • Price changes. If we change prices, existing subscribers get at least 30 days' notice before it affects them.
  • Going over limits. If you exceed your plan's active-record limit, nothing is deleted — records beyond the limit wait, and come back the moment you upgrade.

5. Your data

Everything you put into your CRM — records, files, messages, form responses — is yours. You give us permission to store and process it only as needed to run the Service, as described in our Privacy Policy. We don't sell it, don't use it for ads, and don't let anyone train AI models on it.

You can export your records to spreadsheets in one click, on any plan, at any time. After cancellation your data remains exportable for 90 days, after which we may delete it.

You're responsible for the data you store: that you have the right to store it, and that storing it complies with the laws that apply to you.

6. Sending messages

MagieCRM can send email — and text messages, if you connect a business phone number — to your customers. Those are your messages, sent on your behalf. You're responsible for having the right to contact those people and for complying with applicable law (in the U.S., that includes CAN-SPAM for email and the TCPA for texts). Automated messages only ever send from templates you wrote or approved; you can read every rule your automations run on. If your sending generates spam complaints or abuse reports, we may pause sending from your account while we sort it out with you.

7. AI features, honestly

Magie reads, extracts, and drafts. It's good, and it's not perfect: it can misread a business card, mis-file a lead, or draft an automation that isn't quite what you meant. That's why changes are shown to you before they run and nothing sends without a template you approved. Review what it proposes. Once you approve something, it's yours — treat approval like a signature.

8. Acceptable use

Use the Service for lawful business. Don't:

  • send spam or messages to people who haven't agreed to hear from you;
  • store protected health information — MagieCRM is not HIPAA-certified and we don't sign BAAs;
  • upload anything illegal, or anything you don't have the right to use;
  • probe, overload, or interfere with the Service or other customers' data;
  • resell the Service or use it to build a competing product.

If an account is abusing the Service, we may suspend it. If we do, we'll tell you why and how to fix it, unless the law prevents us.

9. Third-party services

If you connect Google, Stripe, Square, or a phone provider, your use of those services is governed by their terms, and they may charge their own fees. We're responsible for our software, not theirs; if a provider changes or shuts off an integration, we'll do our best to adapt but can't promise their service.

10. Our stuff

We own the MagieCRM software, design, and brand. Your subscription gives you the right to use the Service; it doesn't transfer any ownership of it. If you send us feedback or feature ideas, we can use them without owing you anything — though we'll probably say thanks.

11. Disclaimers

We work hard to keep MagieCRM fast, correct, and available, and we don't promise perfection. The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free. Keep your own judgment in the loop — especially for anything that goes to your customers.

12. Limits on liability

To the maximum extent the law allows: neither of us is liable to the other for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues; and our total liability for all claims arising out of the Service is capped at the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't legally be limited.

13. Indemnity

If someone brings a claim against us because of data you stored or messages you sent through the Service in violation of these terms or the law, you'll defend us and cover the costs of that claim.

14. Ending things

You can stop using the Service and cancel anytime (section 4). We can terminate accounts that violate these terms, or discontinue the Service entirely with at least 90 days' notice — in which case you get a prorated refund and, as always, your export.

15. Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules, and disputes will be resolved in the state or federal courts located in California. Before anyone sues anyone, both of us agree to try to work it out by email first — most things are a misunderstanding.

16. Changes to these terms

If we change these terms, we'll update the date at the top; for material changes we'll email you at least 14 days before they take effect. If you keep using the Service after that, the new terms apply. If you don't like a change, cancel and export — that door stays open.
